OMERS Act, 2006 and Plan texts

The Ontario Municipal Employees Retirement System Act, 2006 (OMERS Act, 2006) was proclaimed into force on June 30, 2006.

The OMERS Act, 2006 established a new independent governance model for OMERS.

OMERS Primary Plan text

A “plan text” is the legal document governing how a registered pension plan is administered.

Under the OMERS Act, 2006, the pension plan that was governed by the old Ontario Municipal Employees Retirement System Act prior to June 30, 2006 is continued as the OMERS Primary Pension Plan (Primary Plan).

The OMERS Administration Corporation (AC) was required to prepare a consolidation of the terms and conditions of the Primary Plan. Consequently, the Primary Plan text was amended and restated as of April 30, 2007.

In the fall of 2007 the OMERS Sponsors Corporation (SC) made four amendments to the Primary Plan.

On October 3, 2007, the SC enacted By-law No. 7. This By-law made three amendments to the Primary Plan regarding inflation protection, pension transfer values and the authority to change contribution rates.

On November 1, 2007, the SC enacted By-law No. 8. It contained an amendment to the Primary Plan pertaining to shortened life expectancy benefits.

The inflation protection amendment was effective January 1, 2008. The other three amendments were effective as of November 29, 2007.

Please note that the Primary Plan text, amended and restated as of April 30, 2007, and SC By-laws No. 7 and 8 must be read together in order to understand the current terms of the Primary Plan.


OMERS Supplemental Plan text

The OMERS Supplemental Pension Plan for Police, Firefighters and Paramedics (Supplemental Plan) came into effect on July 1, 2008. The Supplemental Plan is a separately funded, stand-alone registered pension plan that offers optional benefits that are not available under the Primary Plan.
